2008 Settlements & Awards

In 2008 Don A. Carlos, Jr. successfully obtained awards for many victims of accidents. Some cases were settled, some were the result of trial, some arbitrated or mediated. Here is a sampling of our results:

Medical Malpractice

• A 60 year old man suffering an asthma attack was improperly treated at Columbia Presbyterian Hospital and went into a coma and then passed away. A settlement was reached in a medical malpractice action for wrongful death and conscious pain and suffering.
• A 40 year old woman sustained permanent damage to her right eye during cataract surgery at Columbia Presbyterian Hospital. A settlement was reached with the hospital following depositions. Claims against the doctors are currently pending.

Slip and Fall - Premises Liability

• A 55 year old woman slipped and fell on an icy sidewalk in front of a shopping complex, sustaining a fractured fibula and tibia leg requiring open reduction surgery and the insertion of a steel rod. A settlement was negotiated at a mediation with The Hartford.
• While shopping with her daughter at Associated Supermarkets on Lenox Avenue in Harlem, a woman had a slip and fall accident on a patch of water, and injured her knee with a torn meniscus. Her doctor recommended surgery. A settlement was reached after litigation was commenced, but before depositions.
• A 42 year old woman slipped and fell as a result of water spilled on the floor in Target on West 225th Street in the Bronx. She sustained a torn meniscus knee injury requiring arthroscopic surgery. A settlement was negotiated at a mediation.
• While trying to close a window in a tenement apartment in Washington Heights, a 27 year old woman sustained a deep cut on her ring finger which required ten stitches and surgery to repair a torn tendon, and was left with a scar on her finger. A settlement was negotiated at a mediation before the start of litigation.
• A settlement was negotiated with Claims Administration on behalf of a woman who fractured her ankle after tripping on a cracked and broken sidewalk on 152nd Street on the side of an apartment building. The building owner was responsible for maintaining the sidewalk under New York City law (NYC Administrative Code Section 7-210).

Automobile Accidents

• A 35 year old pre-natal nurse was driving home from work on the New Jersey Turnpike when she was struck by a tanker truck, causing her car to flip over, shattering her driver side window. Glass was embedded in her shoulder requiring over 150 stitches and two surgeries. A settlement was negotiated with AIG.
• A driver involved in collision at intersection in Brooklyn re-injured herniated discs in lower back and neck requiring back surgery. An arbitration award was obtained against Travelers Insurance.
• A passenger in taxi which collided with another taxi running a red light at an intersection in the Bronx. The plaintiff sustained injuries to her knee including a torn ACL and torn meniscus requiring arthroscopic knee surgery. The case settled with American Transit Insurance after jury selection during a Summary Jury Trial.
• One passenger in her car sustained injuries to her neck, back and left knee requiring arthroscopic surgery to repair a torn meniscus, when her vehicle was rear-ended by an SUV. Settlement was negotiated with Travelers after service of a Summons and Complaint in Supreme Court, Bronx County.
• 24 year old graduate student was riding her bicycle home from work on the side walk along Jericho Turnpike in Hempstead, New York, when she was struck by a car pulling out of a parking lot. As a result, she was trapped under the vehicle and sustained a fracture of the inferior pubis ramus of the hip. The case was settled with Liberty Mutual Insurance before trial.
• Motorcyclist struck by a rented automobile at an intersection and sustained a fractured wrist requiring surgery. The case settled with Enterprise and GMAC after deposition of the motorcyclist.
• A pedestrian was struck by a hit and run vehicle resulting in bruising and facial scarring. The case was settled with Motor Vehicle Accident Indemnification Corporation (MVAIC).
